Employer Notice Requirement under the Affordable Care Act


Under the Affordable Care Act, employers are required to give notice about the availability of Health Insurance Marketplace plans. The Department of Labor, under the Fair Labor Standards Act (FLSA), issued guidance recently regarding the employers notice responsibilities. The Marketplace (known in statute as the Exchange) begins January 1, 2014.

Under the FLSA standard, most employers that employ one or more employees are required to comply. Compliance with the notice requirement is not mandatory until October 1, 2013.

Current employees, regardless of their status on a health plan, must be provided notice in writing no later than October 1, 2013.  Notice must be provided in writing to new employees hired on or after October 1, 2013, within 14 days of hire.
